Under the terms of this contract, the under signed parties agree to the following terms and conditions in regard to the sale/purchase of the Yorkshire terrier puppy described below;

All Puppies are sold as pet quality only, there are no guarantees expressed or implied as to adult size of puppy, show potential, temperament

The BREEDER agrees to as follows:

ALL puppies are guaranteed healthy when they leave us, a licensed veterinarian has inspected the said puppy and it is found to be healthy and sound and that is not showing signs of infectious, contagious and/or communicable diseases.
However your veterinarian must see this puppy within 72 hours of pick up in order to validate this contract and a copy of proof of such examination must be sent to the Seller with in 10 business days of this signed contract.
IN the event that a HEREDITARY defect (life threatening) is found which develops to the extent that the puppy must be euthanized before the age of one, a replacement puppy will be offered to the buyer as soon as one becomes available of equal value. No money shall be refunded .
Should the PURCHASER decide on surgical options the BREEDER will not be financially obligated.
IF the PURCHASER decides to euthanized the puppy or in the case of sudden death an autopsy must be performed (at the purchasers expense) by a licensed veterinarian of the sellers choice to determine the cause of death and a copy of the autopsy must be provided to the BREEDER/SELLER.
The BREEDER does not cover the damages or death of a puppy due to hypoglycemia (Low Blood Sugar) This is preventable with good care, proper feeding, proper rest and limited stress.
The BREEDER has informed the PURCHASER of the risk and prevention of hypoglycemia in all small breed dogs.
I the PURCHASER X ________________________________UNDERSTAND THE TERMS AND CONDITIONS OF HYPOGLYCEMIA.
The Breeder does not cover internal or external parasites, hernia, un descended testicles, under or over bite, dental problems ,injury, allergies, heat exhaustion, dehydration, Patellar luxation ( when the knee cap slips out of place, this is usually caused by the puppy jumping on and off furniture) hypothermia, poisoning, tracheal collapse.

This Guarantee is not assignable and is not valid if the puppy/dog is sold to a third party.

The PURCHASER agrees to as follows:
That if this puppy is ever offered for sale or to be given away the BREEDER has the right to first refusal at an amount not to exceed the purchase price, and input into placement of this puppy.
The PURCHASER agrees this dog will NOT BE BRED and spaying/neutering must be performed before this dog reaches 1 year of age {females prior to their first heat cycle, or before 8 months of age}. A statement from the licensed veterinarian who performed the spay/neuter procedure will be forwarded to the BREEDER/ SELLER.
That this pup will be seen within 72 hours of pickup by a Veterinarian, of the PURCHASERS choosing, to validate the health of this puppy.
That the PURCHASER will follow the vaccination schedule to keep this contract valid.
To give this puppy a good and loving home and a responsible upbringing.
To keep the BREEDER informed of any problems, and any changes in location.
That any claims may be required to be confirmed by the BREEDERS veterinarian, and at the PURCHASERS expense.

IT IS MUTUALLY AND SPECIFICALLY AGREED UPON AND BETWEEN THE BREEDER AND THE PURCHASER THAT IF THE PURCHASER BREACHES ANY TERMS OF THIS CONTRACT, THE BREEDER WILL MAINTAIN THE RIGHT, AT THEIR DESCRETION, TO CANCEL THIS CONTRACT AND DEMAND THE RETURN OF THE DOG AND ALL PAPERWORK , REASONABLE ATTORNEY FEES AND DAMAGES.
If any legal actions are brought against Dollard’s Yorkshire Terriers the litigation must be in the jurisdiction of Wyoming County in the state of New York. The purchaser will a assume any and all Attorney fee’s and Court fee’s and will waive charging any cost against Dollard’s Yorkshire Terriers.
THIS IS A LEGALLY BINDING DOCUMENT. BY SIGNING BELOW YOU ARE ACKNOWLEDGING THAT YOU HAVE READ THIS AGREEMENT AN THAT YOU UNDERSTAND ALL THE TERMS SET FORTH THERE IN AND THAT YOU ARE AGREEING TO THEM.
